This appeal has been filed against the order dated 21.09.2024 passed by the learned Children Court cum 1st Additional Sessions Judge, Aurangabad in Regular Bail Petition No. 808 of 2024 arising out of Nabinagar P.S. Case No. 298 of 2023 registered for the offences punishable under Section 364, 302/34 of the Indian Penal Code.

3. As per the prosecution case, all the named accused persons including this appellant came to the house of the informant and after frightening the informant by pistol and lathi and forcibly took her son with them as his son kept Rs. 50,000/- of accused persons.

4. The learned counsel for the appellant has submitted that the appellant is in remand home since 15.05.2024. The appellant has clean antecedent. The informant who is the mother of the deceased has turned hostile.

5. The learned counsel for the State has vehemently opposed the prayer of the appellant.

6. Considering the facts and circumstances of the case, this appeal is allowed. The order dated 21.09.2024 passed by the learned Children Court-cum-1st Additional Sessions Judge, Aurangabad in Regular Bail Petition No. 808 of 2024 arising out of Nabinagar P.S. Case No. 298 of 2023 is hereby set aside.

7. Accordingly, let the appellant, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Children Court cum 1st Additional Sessions Judge, Aurangabad/concerned Court below in connection with Nabinagar P.S. Case No. 298 of 2023.

8. The appeal stands allowed.
