The petitioner is apprehending his arrest in connection with Kinjar P.S.Case no.113 of 2017 registered for offences punishable under Sections 304B/34 of the Indian Penal Code. Petitioner is the father-in-law and the case is of dowry death.
Submission of the learned counsel for the petitioner is that she died due to illness.
Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that there is specific allegation against the petitioner of demanding motorcycle and torturing her for that.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.48966 of 2018 (4) dt.12-09-2018 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit .
With the aforesaid observation, this application is dismissed.
