2. Petitioner seeks bail, who is in custody since 21.07.2022, in connection with Aurangabad (Muffasil) P.S. Case No. 263 of 2022, F.I.R. dated 20.07.2022 registered for the offences punishable under Sections 8/17(b)/18(b) of the N.DP.S. Act.
3. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has been falsely implicated in the present case and earlier the bail petition of the petitioner was rejected vide order dated 19.04.2023 passed in Cr. Misc. No. 55011 of 2022 and other similarly situated coaccused person namely Aklesh Kumar Yadav @ Aklesh Yadav
Patna High Court CR. MISC. No.84911 of 2023(3) dt.23-02-2024 2/2 has been granted bail by a Coordinate Bench of this Court vide order dated 20.03.2023 passed in Cr. Misc. No. 70102 of 2022.
4. Vide order dated 05.01.2024 a report was called for with regard to the stage of the trial. Report dated 15.01.2024 of the learned Trial Court reveals that out of six chargesheeted witnesses, five witnesses have already been examined.
5. Considering the nature of allegation as well as report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Aurangabad (Muffasil) P.S. Case No. 263 of 2022 pending in the Court of learned Special Judge (N.D.P.S.), Aurangabad.
6. Prayer is refused.
7. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U T
