2. The petitioner apprehends his arrest in connection with Birpur P.S. (Bhimnagar) Case No.39 of 2023 dated 31.01.2023 for the offences punishable under Section 8 and 20 (b) (ii) (A) of the NDPS Act and Sections 9, 49 and 51 of the Wildlife Protection Act.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is accorded.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.84631 of 2024(2) dt.07-02-2025 2/2 learned Court below within six weeks from today and seeks regular bail, the learned Court below would pass order on the same day in accordance with law in the light of the verdict of the Hon'ble Supreme Court in the case of Satendra Kumar Antil Vs. Central Bureau of Investigation & Anr. reported in (2022) 10 SCC 51.
