2. The petitioner seeks bail in a case registered for the offence punishable under Sections 8/20(b) II, (B)25 and 29 of N.D.P.S. Act, 1985.
3. As per the prosecution case, 7.249 kg Ganja is said to have been recovered from the house of the petitioner and petitioner's mother was apprehended.
4. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. No incriminating article has been recovered from his conscious physical possession. At the time of alleged recovery petitioner
Patna High Court CR. MISC. No.82592 of 2024(2) dt.20-12-2024 2/2 was not present in the house nor he was arrested by the police at spot. It is further submitted that in this case charge has been framed on 12.11.2024 and summon has also been issued against the witnesses. The petitioner has one criminal antecedent and has been languishing in custody since 13.08.2024.
5. Learned APP for the State opposed the bail petition.
6. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Shambhuganj P.S. Case No. 247 of 2023 (Anjani Kumar Sharan, J) Suruchi/- U T
