The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 341, 323, 366(A), 504/34 of the Indian Penal Code. As per allegation in the FIR, petitioner along with others kidnapped the minor daughter of the informant with a view to marry her.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is father of the main accused Rajeev Kumar with whom victim was in love. Victim is leading her conjugal life with Rajeev Kumar and living at her matrimonial home. She gave birth to a child out of the said wed-lock. Annexure-P/2 is

Patna High Court CR. MISC. No.83089 of 2023(2) dt.02-01-2024 2/2 deposition form in which she has clearly stated that petitioner is father of her husband and she has not whispered anything wrong against him. She is 23 years old. Petitioner is languishing in judicial custody since 23.5.2022.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st, Begusarai in connection with Khodwandpur P.S. Case No. 244 of 2021.
