BAJANTHRI) 24-07-2024 The present MJC is filed without production of certified copy or copy of the order to be recalled and restoration. Therefore, the present MJC for restoration stands dismissed for want of material information with cost of Rs. 1,000/ (Rs. one thousand). Cost shall be remitted in the Patna High Court Legal Services Authority within a period of four weeks, reserving liberty to file fresh MJC after production of subject matter of order dated 05.08.2019 passed in M.A. No. 436 of 2018.
2. At this stage, learned counsel for the petitioner abusing the court process reiterating that the present MJC was filed in the year 2019 and it was the duty of the court to put up
Patna High Court MJC No.4632 of 2019(3) dt.24-07-2024 2/2 the matter for listing. On the other hand, it is to be noted that present MJC was filed in the year 2019. He had a sufficient time to move before commencement of Covid-19 on 28.03.2020. Assuming that he has not moved this court, still he had sufficient time from March 2021 to this day. Prima facie, he has not made out case to the extent what efforts he has made to get the matter listed.
