The petitioner seeks bail in connection with Amarpur P.S. Case No. 147 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 15 liters of illicit country made liquor from the shop of the petitioner. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and he further submits that the petitioner has got no criminal antecedent. Petitioner is in jail custody since 11.10.2019.

In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of

Patna High Court CR. MISC. No.74808 of 2019(2) dt.27-11-2019 2/2 Rs.10,000/- in the court below/Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Banka in connection with Amarpur P.S. Case No. 147 of 2019. Such deposit of Rs.10,000/- shall abide by the outcome of the criminal case.
