2. This application, for grant of anticipatory bail, arises out of Ladaniya Police Station Case No. 124 of 2025, disclosing offences under Sections 274, 275 and 3(5) of Bhartiya Nyaya Sanhita, 2023 and Section 30(a) of Bihar Prohibition and Excise Act.
3. The prosecution case, as per the First Information Report, is that on 17.04.2025 at about 04:15 P.M., the Police official conducted a raid near the Kabristan of Kailasha village. During the operation, a four wheeler Maruti Suzuki bearing Reg. No. DL2CK-9336 was intercepted and two individuals were apprehended after attempting to flee. On search, total 90 litres of Nepali
Patna High Court CR. MISC. No.82255 of 2025(2) dt.10-12-2025 2/3 Garaub Saufi liquor was recovered. Two arrested persons disclosed that they are labour and they did not know anything about the vehicle and the liquor.
4. Learned Counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. It is true that petitioner was the owner of the vehicle, but he had already sold his vehicle to one Dharmendra Kumar prior to the date of occurrence. Petitioner is having clean antecedent and he has no concern with the vehicle in question or the alleged recovery of liquor.
5. Regards being had to the submissions made by the parties and taking into consideration the fact that petitioner had sold the car prior to occurrence and is having no criminal antecedent, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like

No.82255 of 2025(2) dt.10-12-2025 3/3 amount each to the satisfaction of learned Exclusive Special Judge (Excise Court), in connection with Ladniya Police Station Case No. 124 of 2025, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita.
