The petitioner seeks bail in Motihari Town P. S. Case No. 597 of 2019 instituted for the offence under Section(s) 379 Indian Penal Code.

It is submitted by the petitioner's counsel that in the instant case, he has been falsely implicated. It is further submitted that petitioner has no criminal antecedents. It is further pointed out that alleged recovery is not in accordance with law.

The petitioner is in custody since 26.08.2019 wrongly been mentioned as 15.08.2019 in the impugned order. Learned APP for the State opposed the prayer for bail.

Patna High Court CR. MISC. No.75091 of 2019(2) dt.02-12-2019 2/2 Considering the rival submissions of the parties, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Motihari, East Champaran, in connection with Motihari Town P. S. Case No. 597 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
