JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. This is an application for grant of Anticipatory Bail in connection with N.D.P.S. Case No. 39 of 2019 arising out of Excise Case P. R. No. 39 of 2019, registered for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act.

The allegation is regarding the recovery of 50 kg of Ganja from a Bolero vehicle and the co-accused person, namely, Anil Pandey was arrested from the spot.

The learned counsel for the petitioner has submitted that neither the petitioner is driver of the said vehicle in question nor the owner of the said vehicle and he has got no concern with

Patna High Court CR. MISC. No.76140 of 2019(2) dt.25-11-2019 2/2 the recovered Ganja. It has been further submitted that the petitioner has falsely been implicated in the present case and is having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on Anticipatory Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of leaned 6th Additional Sessions Judge, Motihari, East Champaran in connection with N.D.P.S. Case No. 39 of 2019 arising out of Excise Case P. R. No. 39 of 2019, subject to the conditions as laid down under Section 438(2) of the CrPC.
