2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Sathi P.S. Case No. 123 of 2021 registered for the offence punishable under Sections 363, 366-A/34 of the Indian Penal Code and Section 8/12 of the POCSO Act.
3. Earlier the bail application of the petitioner has been rejected vide order dated 25.01.2023 passed in Cr. Misc. No. 46514 of 2022.
4. The allegation against the petitioner is of kidnapping a minor girl. The petitioner is in custody since
Patna High Court CR. MISC. No.84437 of 2024(5) dt.20-06-2025 2/2 26.07.2021.
5. Considering the delay in the trial and the period of custody, this application is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum-Special Judge, under POCSO Act, West Champaran at Bettiah in connection with Sathi P.S. Case No. 123 of 2021.
7. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
