The petitioner has been in custody since 01.10.2019 in connection with Brahmpur P.S. Case No. 426/2019 registered for the offence punishable under Sections 30(a) of the Excise Act.

Considering the fact that the alleged recoveries were not from the conscious possession of the petitioner, but from the motorcycle which was given by some other person who fled away and also because the petitioner has no criminal antecedents, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge cum Special Judge (Excise),
