The matter has been taken up through video conferencing.

The petitioner seeks direction upon the respondents for payment of pension, arrears of pension, GPF, leave encashment, GSS, gratuity, ACP, overtime allowance and dress allowance.

The respondents filed counter affidavit stating therein that petitioner superannuated on 28.02.2019 and pension, arrears of pension, GPF, leave encashment, GSS, gratuity, ACP, overtime allowance and dress allowance have already been paid to the petitioner through different cheques. The learned counsel for the petitioner admits payment of pension, arrears of pension, GPF, leave encashment,

Patna High Court CWJC No.22686 of 2019(5) dt.28-08-2020 2/2 GSS and gratuity but disputes the amount of ACP and submits that petitioner is entitled to get ACP from 01.01.2019 but the petitioner was granted 3rd ACP with effect from 07.09.2019 vide memo No. 94 and an amount of Rs. 45,236/- was ordered to be paid through cheque No. 636700. If there is dispute on this point the petitioner may file a representation before the competent authority who shall dispose of the representation of the petitioner within three months from the date of its filing. The cheque No. 636782 dated 15.09.2019 of Rs. 1,25,832/- for overtime allowance and cheque No. 209568 of Rs. 6375/- dated 18.01.2020 in the head of dress allowance have already been issued but the petitioner disputes the credit of aforesaid cheques in his account. The respondents are directed to verify the matter and if no payment is made in the head of overtime allowance and dress allowance the same should be paid to the petitioner within one month.

With the aforesaid direction, this writ petition is disposed of.
