20-08-2018 Heard Sri Dhirendra Nath Jha, learned counsel for the petitioner and Sri Dinesh Singh, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 02-06-2018 in Jamalpur P.S. Case No. 152 of 2018 registered for offence under Sections 461, 379 of the Indian Penal Code, has prayed for grant of bail.
Learned counsel for the petitioner, at the very outset, has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He further submits that nothing was recovered from conscious possession of the petitioner and only on suspicion, petitioner has been apprehended and he is in custody.
Learned Addl. Public Prosecutor has opposed the
Patna High Court Cr.Misc. No.50441 of 2018(2) dt.20-08-2018 2/2 prayer for bail.
However, considering the nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Rishu Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Jamalpur P.S. Case No. 152 of 2018.
