2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 313 and 376 of the Indian Penal Code and section 6 of the POCSO Act.

3. As per the prosecution case, on the false promise of marriage this petitioner established physical relation with the informant.

4. Learned counsel appearing for the petitioner submits that by the intervention of well wishers, marriage has been solemnized between the petitioner and the informant on 10.09.2023 and parties are enjoying happy marital life. An affidavit has also been filed on behalf of the informant stating that the informant has married with the petitioner on 10.09.2023 in presence of family members of both sides at Sundari Math Temple. Informant has further stated that she is living with the petitioner at her matrimonial house.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Special Judge, POCSO Act, Araria. subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
