The petitioner seeks regular bail in connection with Murliganj PS case no. 238 of 2019 instituted for the offence punishable under Sections 379/411 of Indian Penal Code.
The allegation is regarding the petitioner herein being involved in stealing motorcycles and two motorcycles are said to have been recovered from him.
The learned counsel for the petitioner has submitted that the fact is that the motorcycles have been recovered actually from the premises of the police station and as far as the petitioner is concerned, he is an accused in one other case but he is on bail in the said case. It is further submitted that

No.72866 of 2019(2) dt.04-12-2019 2/2 similarly situated co-accused person has already been granted bail by a co0ordinate Bench of this Court vide order dated 01.10.2019 passed in Cr. Misc. no. 61149 of 2019. Lastly, it is submitted that the petitioner is languishing in custody since 03.07.2019.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-IInd, Madhepura in connection with Murliganj PS case no. 238 of 2019.
