The petitioner is apprehending his arrest in a case registered under Sections 420, 467, 468, 471, 120B of the Indian Penal Code. Allegation is that the accused persons including the petitioner have been found responsible for dishonestly and fraudulently tampering and misappropriating with the records related to employment of the teachers and with their conspiracy their favourable persons were appointed.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is the
Patna High Court CR. MISC. No.74247 of 2019(2) dt.27-11-2019 2/2 panchayat Secretary of the concerned panchayat. There was no intention of the petitioner to cause any wrongful gain or wrongful loss. The candidate in question was already selected in some other panchayat. The appointment of the candidate in question was made on the basis of recommendation made by the District Appointment Authority.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S. case No.170 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
