====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-02-2025 Heard learned Counsel for the petitioner as well as learned APP for the State.
2. In this case, the petitioner is seeking regular bail in connection with Govindganj P.S. Case No. 24 of 2024 registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
3. As per allegation, 58 ATM Cards were recovered from the pocket of the petitioner. He alleged to have involved in cyber crimes.
4. The learned counsel for the petitioner has submitted that there is no evidence that the petitioner is involved in cyber crime. It has also been submitted that although his prayer for bail was earlier rejected but the petitioner is renewing his prayer
Patna High Court CR. MISC. No.85365 of 2024(2) dt.14-02-2025 2/2 for bail on the ground of his prolonged custody of one year. The petitioner is a person of clean antecedent.
5. On the other hand, the learned APP for the State opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances especially the clean antecedent and prolonged incarceration of the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran, Motihari in connection with Govindganj P.S. Case No. 24 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
7. Before accepting the bail bond of the petitioner, the learned court below shall verify his criminal antecedent and if it is found that he is involved in any other case except the present one, his bail bond shall not be accepted. (Nawneet Kumar Pandey, J) Neha/- U T
