The petitioner seeks bail in connection with Ranitalab P.S. Case No. 382 of 2023, instituted for the offences under Sections 302, 120B, 34 of the Indian Penal Code, read with Sections 25(1-B)(a) and 27 of the Arms Act. 3.

This is the second attempt of the petitioner for bail. The petitioner has renewed his prayer for grant of regular bail which was earlier rejected by this Court vide order dated 11.07.2025 passed in Cr. Misc. No. 17329 of 2025 taking into account the nature and gravity of the offence as also the criminal antecedents of the petitioner.

In compliance of the order dated 12.12.2025, a report dated 23.12.2025 with regard to the present stage of trial has been received. From perusal of the aforesaid report, it appears that charge has been framed against the petitioner on 19.07.2025 and out of fifteen charge-sheeted witnesses, only three witnesses have been examined in this case. It is further reported that the trial is likely to be concluded within a period of nine months.

Learned counsel for the petitioner submits that the petitioner is languishing in judicial custody since 08.10.2024 without any rhymes or reason. It is further submitted that other co-accused have been granted regular bail by this Court vide order dated 10.10.2025 passed in Cr. Misc. No. 58744 of 2025 and Cr. Misc. No. 61220 of 2025.

Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner and has submitted that the petitioner bears thirty criminal antecedents.

There is no new ground to consider the bail petition of the petitioner. From the aforesaid report, it appears that the trial is in progress. Considering the huge number of criminal antecedents of the petitioner, this Court is not inclined to grant

In view of the above, the prayer for bail of the petitioner is again rejected with a direction to the court below to expedite the trial and conclude the same preferably within a period of five months from today.
