2. The petitioner apprehends her arrest for the offences punishable under Section 108/3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. The allegation in the first information report is that the daughter of the informant committed suicide by hanging due to the fact that her husband was having an illicit relationship with her step mother-in-law (petitioner) and she was being ill treated by them.
4. Learned counsel for the petitioner submits that the allegations in the first information report are not correct and, as a matter of fact, it was the husband of the deceased lady who had immediately informed about the incident to her parents that

He further submits that there is no tangible evidence on record to show that the petitioner had ever indulged in inflicting any cruelty upon the deceased and in absence of any act acting as a live or proximate link for suicide committed by her, no case u/s 306 IPC would be made out. He further submits that the allegation of illicit relationship is absolutely false. As a matter of fact, the victim was suffering from schizophrenia and she has taken an extreme step without sufficient cause. By filing a supplementary affidavit, learned counsel for the petitioner has brought on record that the husband of the deceased lady has already been arrested on 19.05.2025 and since then he is in custody. Moreover, it is the petitioner who is primarily responsible for the welfare of his wife.

Taking into consideration the facts and circumstances of the case as well as the fact that the husband of the deceased is already in custody, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.82793 of 2024(6) dt.08-07-2025 3/3 each to the satisfaction of the learned Court below where the case is pending/ successor Court in connection with Rupaspur P.S. Case No.509 of 2024, subject to the condition as laid down under Section 482 (2) of the B.N.S.S.
