From para-33 of the case diary, it is evident that other co-accused has been found innocent while paucity of evidence has been found against the petitioner, Anil Kumar whereupon, final report has been submitted.

In the background of aforesaid development, learned counsel for the petitioner seeks withdrawal of the instant petition, at the present moment, with a prayer that in case, during course of cognizance, the learned magistrate differs from the conclusion arrived at by the I.O., then in that circumstance,
