2. The petitioner is in custody since 20.09.2023 in connection with Jogbani P.S. Case No. 240 of 2023 registered for the offence punishable under Sections 21/22/ of the NDPS Act.

3. As per the prosecution case, the following items have been recovered from the house of the petitioner: (1) Pheniramine Maleate injection 532 Nos (2ml each) 1064 ml.

(2) Lupigestic injection 504 Nos (2ml each) total 1008 ml.

(3) Phenergan injection 424 Nos (2ml each) tootal 848 ml.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. It is submitted that the petitioner is not concerned with the alleged recovery. Learned counsel further submits that the recovery has been made from the joint house of the petitioner. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the fact that there is huge recovery of narcotics from the petitioner and it is a case of NDPS Act, I am not inclined to grant bail to this petitioner. It is, accordingly, dismissed.
