Petitioners pray for bail in connection with Special Case No. 30 of 2018, arising out of Kotwali P.S.Case No. 212 of 2018 registered for the offences punishable under Sections 401, 413, 414, 411, 379 of the Indian Penal Code and Sections 18, 20, 21(B), 22(C) of N.D.P.S. Act.

Allegation is of recovery of 500 grams of ganja from each of the petitioners and it appears that petitioners are accused in three other cases, not of similar nature.

Submission of learned counsel for the petitioners is that

Patna High Court Cr.Misc. No.49298 of 2018 (3) dt.03-10-2018 2/2 petitioners have falsely been implicated in this case and recovery quantity of ganja is within the small quantity and petitioners are in custody for five months and though they have been made accused in three other cases but all those cases are against unknown. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, N.D.P.S. Act, Patna, in connection with Special Case No. 30 of 2018, arising out of Kotwali P.S.Case No. 212 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
