The petitioner, who is in custody since 22.08.2019, seeks bail in connection with Sikrahata P. S. Case No. 51 of 2019 dated 20.04.2019 instituted for the offence under Section 393 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

The petitioner has not been named in the F.I.R. and only during the course of investigation, his name has transpired.

The petitioner has clean antecedents but

Patna High Court CR. MISC. No.78727 of 2019(3) dt.17-03-2020 2/2 somehow or the other, while rejecting the prayer for bail of the petitioner, the court below has recorded that the petitioner has criminal antecedents.

The learned counsel for the petitioner submits that this is an error of record.

Considering the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhojpur at Ara in connection with Sikarhata P. S. Case No. 51 of 2019.
