The petitioner seeks pre-arrest bail in connection with Beldour P. S. Case No.189 of 2018 registered under Sections 328, 302/34 of the Indian Penal Code.

Considering the statements of independent witnesses, namely, Vilash Mahto and Shiv Mahto, which have been recorded in paras 37 and 38 of the case-diary, as also the opinion of the Sub-Divisional Police Officer, which has been recorded in para-20 of the case-diary wherein it has been stated that the victim had himself consumed poison and while being taken to hospital for treatment he died and the informant mischievously

Patna High Court CR. MISC. No.75264 of 2019(3) dt.16-06-2020 2/2 named the petitioner as the person, who administered poison as he had tendered some loan to the deceased, in the event of arrest or surrender before the court below, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in Beldour P. S. Case No.189 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
