2. The petitioner is in custody in connection with Manpur P.S. Case No. 100 of 2024 for the offence punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 74, 329(4), 109, 352 and 303(2) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act lodged on 20.07.2024 by the informant, Neetu Devi.
3. As per the prosecution story, the informant alleged that in the evening when she came out of the door, the accused persons including this petitioner were there and after abusing, allegation is that this petitioner opened fire causing injury on her leg. She became unconscious and regained consciousness only in the Hospital. This led to the FIR.
4. Though learned counsel for the petitioner tried to
Patna High Court CR. MISC. No.84108 of 2024(2) dt.10-12-2024 2/2 submit that there is a case and counter case and both side have suffered, learned APP has pointed out that he has nine criminal cases of same nature and allegation against him is of opening fire on a lady.
5. Considering the submissions put forwarded by the parties as also the allegation that has come against the petitioner coupled with the fact that he has nine criminal cases of almost same nature against him, no relief can be granted to him.
