Mr.Pushpa Sinha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Sri Krishnapuri P.S. Case No. 336 of 2018, registered under Section 379 of the Indian Penal Code and later on, Section 411/34 of the Indian Penal Code has been added.

Learned counsel for the petitioners submits that petitioners are not named in the FIR but in course of investigation, one Golu was apprehended with the stolen motorcycle, in connection with Kotwali P.S. Case No. 896 of 2018, who confessed his guilt showing the involvement of the petitioner and petitioner was also remanded in Kotwali P.S.

Patna High Court CR. MISC. No.72865 of 2019(4) dt.05-03-2020 2/2 Case No. 896 of 2018 and thereafter, petitioner has been remanded in the present case on 26.12.2018.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Patna, in connection with Sri Krishnapuri P.S. Case No. 336 of 2018. Out of two sureties, one surety must be the close relative of the petitioner and further the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
