JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-09-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 45(C)/2018, registered for offences punishable under Sections 498(A) of the Indian Penal Code. Allegation against the petitioner is of demand of Rs. 1 lakh as dowry and also of ousting the complaint from the house. It has been submitted on behalf of the petitioner that complaint petition itself shows that she was ousted from the house on 23.01.2018 and the complaint petition was filed on 09.01.2018 and, thereafter, a maintenance case was also filed by the complainant, which clearly shows that complainant does not want to live with the petitioner.

Patna High Court Cr.Misc. No.51316 of 2018 (2) dt.14-09-2018 2/2 Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail. Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur, Ara in connection with Complaint Case No. 45(C)/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, and also with condition that petitioner shall cooperate in the maintenance case, otherwise, the prosecution will be at liberty to move for cancellation of his bail bonds.
