2. The petitioner is in custody in connection with Narari Kala Khurd P.S Case No. 74 of 2025 registered for the offences punishable under Sections 717(5), 336(2), 318(4), 336(3) of B.N.S.
3. As per prosecution case, on police checking petitioner was failed to produce the documents of motorcycle.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that bike seized from the petitioner was taken by the petitioner from his known person, namely, Sumit Kumar
Patna High Court CR. MISC. No.78426 of 2025(2) dt.03-12-2025 2/2 who purchased second hand bike from one Suraj Kumar on 04.07.2024. It is further submitted that petitioner has got no criminal antecedent as stated in paragraph no. 3 of the bail petition. It is also submitted that petitioner is in judicial custody since 07.08.2025.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order, it appears that petitioner has got clean antecedent and he is in custody since 07.08.2025.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Narari Kala Khurd P.S Case No. 74 of 2025.
