2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 324(4), 305(1), 125(1), 125(2), 126(2), 115(2), 117(2), 118(2), 109, 352, 351(2) of the Bharatiya Nyaya Sanhita.

3. According to the prosecution story the petitioners are said to have assaulted the informant and others by various means and there has been specific allegation against petitioner no. 1 of assaulting the informant by fists and leg. The reason behind the occurrence is said to be land dispute.

4. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. He

Patna High Court CR. MISC. No.83273 of 2024(3) dt.31-01-2025 2/2 has been falsely implicated in this case. The allegation levelled against the petitioners is rather general and omnibus in nature. There is admitted land dispute between the parties. Both sides have filed cases against each other. Similarly situated co-accused persons have been enlarged on bail by this court vide order dated 04.12.2024 passed in Cr. Misc. No. 79675 of 2024 and. Petitioners have no criminal antecedent as mentioned in para-3 of this application.

5. Learned APP for the State opposes the prayer for bail.

6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Bahadurganj P.S. Case No. 192 of 2024, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023.
