The petitioners apprehend their arrest in connection with Gogri P.S. Case no. 314 of 2019, registered under Sections 436, 504, 506, 427 and 120-B/34 of the Indian Penal Code.

The accusation is that on 16.09.2019 at about 2.00 A.M. when informant Anil Prasad Yadav woke up then saw that petitioners were sprinkling petrol kept in containers by them then informant entered in the house and woke up to his other

Patna High Court CR. MISC. No.73112 of 2019(2) dt.21-11-2019 2/2 family members and started raising alarm then they put fire on motorcycle moved from there on fear reaching of the villagers. Learned counsel for the petitioners submits that petitioners are Gotia next door neighbour of the informant and his motorcycle, which was kept in front of his house burnt in the night, but due to family dispute petitioners have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent, except, petitioner No.1 Tamardwaj @ Sudhanshu Kumar as detailed in paragraph No.3 of the petition.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 314 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
