Heard learned counsel for the petitioners, learned AC to GP-10 and the learned counsel, Shri. Manish Dhari Singh, appearing on behalf of the Bihar State Road Development Corporation.

Learned counsel appearing on behalf of the Bihar State Road Development Corporation submits that Road Development Corporation is a necessary party but then the Bihar State Road Development Corporation has not been impleaded as a party respondent. It is next submitted that the Respondent No. 4, i.e., Managing Director, Bihar State Pool Construction Corporation Limited, is not a necessary party in the instant case as the project in question was being carried out by the Bihar State Road Development Corporation.

Learned counsel for the petitioners, at this stage, seeks permission to withdraw the writ application with liberty to file afresh with proper pleadings and necessary party.

Permission is accorded.

Accordingly, the instant writ application is dismissed as withdrawn with liberty aforesaid.
