2. The petitioner seeks regular bail in connection with Koilwar (Gidha) P.S. Case No. 539 of 2023 dated 05.09.2023, lodged under Sections 302 and 201 of the I.P.C.
3. As per the prosecution case, the F.I.R. has been lodged against four named accused. The deceased was killed in the factory premises. During investigation, it has come that the deceased was given poison by Shailesh Sah and thereafter, the petitioner and others caught the deceased, so that he may not make any sound.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner is in custody since 08.09.2023 having clean
Patna High Court CR. MISC. No. 84095 of 2023(2) dt.10-01-2024 2/2 antecedent. He further submits that the petitioner is not named in the F.I.R. His name has figured in this case by virtue of the confessional statement of co-accused, Mukesh Sah.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the fact that the petitioner is an active participant in the killing of the deceased, I am not inclined to grant bail to the petitioner and therefore, the present bail application is hereby rejected.
7. The Trial Court is directed to expedite the trial as early as possible.
