The petitioner is accused in connection with Daudnagar P.S. Case No. 291 of 2019, registered under Sections 420, 467, 468, 471, 483, 414 and 401 of the Indian Penal Code. The accusation is that in course of patrolling duty, informant received information about reaching of some persons in cattle fair with two stolen motorcycles. Thereafter, informant along with other police personnel reached in the cattle fair then saw that near the passenger shed, two motorcycles were parked where three persons were present. On seeing the police party, the aforesaid three persons started to flee away, but on chased, they were apprehended, who disclosed their names as Dinesh

Patna High Court CR. MISC. No.73444 of 2019(3) dt.16-03-2020 2/2 Kumar, Utpal Kant and Vikash Kumar (petitioner). On query, they did not give satisfactory reply about the aforesaid two motorcycles and they also disclosed that both motorcycles are stolen motorcycles.

Learned counsel for the petitioner submits that, in fact, petitioner had gone to cattle fair, where petitioner along with two others named in the FIR had been arrested mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 10.09.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No. 291 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
