JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 17.1.2018, seeks bail in Rivilganj PS Case No. 17 of 2018 registered under Sections 25(1B)A, 26 and 35 of the Arms Act. Accusation is that number of criminals had assembled making plan for committing dacoity and the police recovered arms from many of them as well as some stolen motorcycles and one country made pistol with three live cartridges was recovered from the possession of the petitioner.
Learned Counsel for the petitioner submits that the petitioner has remained in custody for more than sic months and he had no criminal antecedent prior to institution of the present case, however, two cases were instituted relating to the present occurrence and other co-accused have been granted bail by this Court as well as coordinate Benches of this Court considering their antecedent and period of custody.
Having considered the said facts and circumstances, the petitioner, namely, Pappu Kumar Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VIIIth, Saran at Chapra in connection with Rivilganj PS Case No. 17 of 2018 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner.
(ii) The petitioner shall appear before the trial court on each
Patna High Court Cr.Misc. No.49274 of 2018 (2) dt.10-08-2018 date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
