The petitioner seeks bail in connection with S. Tr. No. 222 of 2019 arising out of Govindpur P.S. Case No. 21 of 2019, registered under Sections 302 of the Indian Penal Code, 27 of the Arms Act and 15, 16, 18 and 20 of the Unlawful Assembly of People's Act.
Submission is that on the basis of fardbeyan of informant, the above mentioned case was instituted on 06.02.2019 and in course of investigation the name of the petitioner surfaced in the confessional statement of co-accused Manoj Kumar Mehta, thereafter, the petitioner was apprehended in this case and his confessional statement was recorded. Except the confessional statement, no tangible evidence
Patna High Court CR. MISC. No.75146 of 2019(3) dt.19-03-2020 2/2 collected by the investigating officer during investigation. More so, Manoj Kumar Mehta, has already been allowed the privilege of bail vide Cr. Misc. No. 12047 of 2020 on 29.02.2020. The petitioner is in custody since 02.04.2019.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 222 of 2019 arising out of Govindpur P.S. Case No. 21 of 2019 to the satisfaction of the Additional Sessions Judge, VII, Nawadah, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
