Petitioner seeks bail in Patahi P.S.Case No.96 of 2018 registered for the offences under Sections 399, 402, 414, 465, 467, 468,471, 120(b) of the I.P.C. and Section 25(1-b), a, 26, 35 of the Arms Act.

Informant is the Officer-in-Charge who in his self statement has stated that on 23.5.2018 at about 11.45 P.M. he received a secret information that some criminals had assembled to commit some big crime and on such information police party reached the place of occurrence and arrested five persons on the spot and 8-9 persons managed to escape taking advantage of darkness.

Submission of the learned counsel for the petitioner is

Patna High Court Cr.Misc. No.49746 of 2018 (2) dt.25-09-2018 2/2 that nothing has been recovered from possession of the petitioner and having no criminal antecedent he is in custody since 25.5.2018. Further submission is that co-accused having similarly situated has already been granted bail by this Court vide order dated 06.08.2018 passed in Cr.Misc.No.48063 of 2018. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 8th A.C.J.M., East Champaran at Motihari, in Patahi P.S.
