The petitioner seeks bail in a case registered under Section8 of the POCSO Act. The allegation against the petitioner is of eve-teasing the minor daughter of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 30-06-2018 and the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has already been submitted in this case. It is a case of eve teasing. The petitioner has been made accused in this case due to mistake of fact. The allegation made in the FIR is denied by the petitioner.
Patna High Court Cr.Misc. No.50046 of 2018 (3) dt.13-09-2018 On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-POCSO Act, Motihari, East Champaran in connection with Piprakothi P.S. Case No. 115 of 2018.
