The petitioner is apprehending his arrest in connection with Amour P.S. Case No. 116 of 2019 for the offence registered under Sections 7 of the E.C. Act and Sections 420, 120 (B) and 414 of the Indian Penal Code.

Learned Senior counsel for the petitioner submits that an inspection was held in the midst of business hours and only because the petitioner could not explain with precision the exact number of cylinders present and those sold prior to the inspection and also because the accounts after closing of the business were not clear, the present case has been lodged against the petitioner making the allegation as contained in the first information report. It is further submitted that the petitioner shall offer the necessary explanation to the authorities and he shall not abscond or tamper with any evidence.

No.73142 of 2019(2) dt.25-11-2019 2/2 Considering the aforesaid facts and circumstances of the case and the nature of allegation and also because the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Purnea in connection with Amour P.S. Case No. 116 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
