JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner happens to be Proprietor of Max Hospital which was found running violating the provisions of Biomedical waste management Rule 2016 and Nursing Home Rule 2013 as well as P.C PNDT Act.

Although, the present F.I.R was lodged under the above stated acts and rules but except section 188 of the Indian Penal Code no section of the above stated acts or rules have been mentioned in the F.I.R.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on

Patna High Court CR. MISC. No.86671 of 2019(2) dt.13-02-2020 2/2 bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Nawada Town P.S. Case No. 713 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
