The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 79, 98, 111, 143, 145, 99, 96, 296 and 3 (5) of the BNS and Section 13 and 14 of the POCSO Act as well as Section 79 of J.J. Act & Sections 16, 17 and 18 of the Child and Adolescent Labour ( Prohibition and Regulation) Act.
3. The case of the prosecution is that the petitioner along with others was running an Orchestra. Two minor girls were recovered. It is alleged that those girls were subjected to physical and sexual cruelty if they refused to perform. From perusal of the order of the learned trial Court, it is clear that the
Patna High Court CR. MISC. No.80120 of 2025(2) dt.03-12-2025 2/3 victims made their statement under Section 180 of the BNSS and they have supported the allegation made in the FIR.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the petitioner runs an Orchestra and the girls were hired only for performing at that Orchestra. It is further submitted that coaccused person, namely, Manish Kumar has been granted bail by a Bench of this Court vide order dated 19.11.2025 passed in Cr. Misc. NO. 76425 of 2025 and co-accused, namely, Golu Kumar Singh, has been granted bail by a co-ordinate Bench of this Court vide order dated 18.11.2025 passed in Cr. Misc. No. 72595 of 2025. Moreover, the petitioner is languishing in judicial custody since 04.09.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Baikunthpur P.S. Case No. 318 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned
