Mr. Sanjay Kumar Sharma ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 25-09-2018 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 302, 201/34 of the Indian Penal Code. In the written report it is alleged that these petitioners along with 25 named accused persons and 56 unknown assaulted Prakash Yadav as a result whereof he died. It has further been submitted that other accused with similar allegation have already been granted anticipatory bail by a coordinate Bench of this Court passed in Criminal Miscellaneous No.52186 of 2017 by order dated 21.11.2017, Criminal Miscellaneous No.7190 of 2018 by order dated 09.02.2018 and

Patna High Court Cr.Misc. No.50806 of 2018(2) dt.25-09-2018 2/2 Criminal Miscellaneous No.6163 of 2018 by order dated 17.02.2018.

Considering the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Khajekalan Police Station Case No.137 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
