27-11-2019 Heard learned counsel for the parties.
The petitioner seeks bail in Pusa P.S. Case No. 39 of 2019 registered for the offence under Sections 364-A/34 of the Indian Penal Code.
It is a case of kidnapping for ransom of grand son of informant and petitioner's mobile phone was used in the said kidnapping.
It is submitted on behalf of petitioner that F.I.R. has been lodged against unknown. Only evidence against the petitioner is that his mobile phone was used in the kidnapping. It is further submitted that statement of the victim has been recorded under Section 164 of the Cr.P.C., in which, name of the petitioner has not been disclosed. Petitioner is in custody

Considering the aforesaid facts and circumstances as well as statement of the victim recorded under Section 164 Cr.P.C., let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, District - Samastipur in connection with Pusa P.S. Case No. 39 of 2019, on the following conditions:
(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
