2. The petitioner seeks bail in connection with Bairiya P.S. Case No. 223 of 2024 registered for the offence under Sections 103, 3(5) of the Bhartiya Nyay Sanhita.

3. As per the prosecution case, the petitioner is the tenant of the deceased. He entered the house of the petitioner with an intention to have sex with the wife of the petitioner and because of the same he was killed.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has committed no offence. The petitioner is in custody since 4.7.2024.

5. Considering the facts of the case, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-III, West Champaran at Bettiah/concerned Court below in connection with Bairiya P.S. Case No. 223 of 2024.
