Petitioner seeks bail in a case registered for the offence punishable under Section 354/34 of the Indian Penal Code, Section 12 of the POCSO Act and Section 37(1) of the Bihar Prohibition and Excise Act, 2016.

The petitioner and another accused Pranav Yadav are said to have dragged the minor daughter of the informant in inebriated condition with bad intention by holding her hand from the shop in the course of returning balance money by his daughter to them and also extended threatening.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner has

Patna High Court Cr.Misc. No.49204 of 2018 (2) dt.10-08-2018 2/2 no concern with the aforesaid occurrence. He had not consumed any liquor. He happens to be teetotaller. He has been falsely implicated in the case by the informant over some altercation made between the informant and the petitioner over purchasing of the articles from the shop of the informant and returning the money. Chargesheet in the case has been submitted. He has no criminal antecedent. He has been languishing in custody since 03.03.2018. Similarly situated co-accused namely Pranav Yadav has been enlarged on bail by this court vide order dated 21.06.2018 passed in Cr. Misc. No. 33116 of 2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 121 of 2018.
