====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 27-11-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners are apprehending their arrest in connection with Gaurichak P.S. Case No. 46 of 2025 registered for the offences punishable under Sections 352, 351(3), 3(5), 109 of the B.N.S and section 27 of the Arms Act.
3. As per prosecution case, the accused persons, five in number, including the present petitioners, resorted to indiscriminate firing at the informant's house with the intention to kill and also engaged in verbal abuse and threats.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.78262 of 2025(2) dt.27-11-2025 2/3 petitioners are innocent and have committed no offence as alleged in the FIR. There is general and omnibus allegations against the petitioners. Nothing has been recovered from the place of alleged occurrence, which indicates that no such incident, as alleged, took place. This fact raises doubt about the veracity of the entire prosecution case. There is land dispute in between the parties and the present case is nothing but only filed to harass the petitioners. Learned counsel for the petitioner submits that co-accused Madhu Singh & Bohla Singh, on the same and identical allegation, have already been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 62697 of 2025 and on the principle of parity petitioner deserve anticipatory bail. Petitioner bear no criminal antecedent.
5. The learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioners and submits that the petitioners are F.I.R. named accused and he cannot escape from the allegation made in the F.I.R.
6. Considering the facts and circumstances of the case, co-accused, on the same and identical allegation, has already been granted bail by a Co-ordinate Bench of this Court, keeping in view clean antecedent of petitioners, argument

No.78262 of 2025(2) dt.27-11-2025 3/3 advanced on behalf of both sides and also taking into consideration the material available on record, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 2nd, Patna City, Patna in connection with Gaurichak P.S. Case No. 46 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.
7. The application stands allowed.
