====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-08-2018 Heard Sri Abhimanyu Deo, learned counsel for the petitioner and Sri Mrityunjay Kumar Nirala, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 4.4.2018 in connection with Digha P.S. Case No. 179 of 2018, registered for the offence under Sections 399, 402 & 34 of the Indian Penal Code, 1860 and Section 25 (1-b)a & 26 of the Arms Act, 1959 , has prayed for grant of bail.

Learned counsel for the petitioner submits that petitioner has falsely been implicated on an accusation as if petitioner along with others had assembled at a place for committing dacoity and they were preparing for committing dacoity. He submits that from possession of the petitioner no incriminating articles were recovered save and except one

Patna High Court Cr.Misc. No.49414 of 2018(2) dt.20-08-2018 2/2 mobile which was his own mobile . Learned counsel for the petitioner has also drawn my attention to the statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent.

Sri Mritunjay Kumar Nirala, learned Additional Public Prosecutor has vehemently opposed the prayer for bail. He submits that petitioner along with other two persons were arrested, however three accused persons fled away and from other two accused arms and ammunitions were recovered. Be that as it may, considering the nature of accusation and period of custody, let the petitioner - Arjun Ram @ Arjun Das be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna / concerned court in connection with Digha P.S. Case No. 179 of 2018.
