Petitioners are apprehending their arrest in connection with Chainpur P.S.Case No.244 of 2019, Gr. No.1343 of 2019, registered for offences punishable under Sections 420 & 409/34 of the Indian Penal Code.

Petitioners happen to be the President and the Secretary of Ward Kriyawan Samity. There is allegation of defalcation of money allotted under Pel Jal Nishchay Yojana. There is allegation that they had been allotted Rs.12,34,400/- but they have completed the work of Rs.09 lac and defalcated the money.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.74372 of 2019(2) dt.17-01-2020 2/2 that Annexure-2 is a letter written by Block Prakhand Officer, Chainpur stating that after measurement, it has come that the petitioner has completed work of Rs.11,03,646/- . Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Kaimur at Bhabua in connection with Chainpur P.S.Case No.244 of 2019, Gr. No.1343 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With the above direction, this application is allowed. (Vinod Kumar Sinha, J) chn/- U T
