The petitioner seeks regular bail in connection with Pipra P.S.Case nO.276 of 2018 giving rise to S.t. (Excise) No.849 of 2018 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 51 ltrs. of nepali liquor and the petitioner is named in the FIR. Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession. There is no source of identification and he is in custody for almost four months. He has no criminal antecedent and the charge sheet has been submitted, as such there is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge (Excise) at Supaul in connection with Pipra P.S.case No.276 of 2018. With the aforesaid observation, this application is allowed.
